Breve análise do futuro do mercado jurídico brasileiro.

Poucas pessoas estão observando, mas estamos vivendo um dos momentos mais relevantes do mercado jurídico brasileiro. E não por conta da AI, mas em decorrência de uma possível abertura, ou não, do mercado para investidores externos.

Esse fenômeno já ocorreu no Reino Unido. No Brasil, no entanto, quem vai decidir isso será o Judiciário.

A verdade é que quase 100% dos orçamentos dos departamentos jurídicos são destinados aos escritórios de advocacia. Empresas de tech que atendem grandes empresas ficam com uma fatia menor. Outras optam por atender escritórios e acabam sendo "revendidas" e "incorporadas" ao custo dos honorários.

No entanto, a Enter fez um movimento diferente. Após observar que não seria possível capturar valor expressivo vendendo tech, passou a adotar um modelo em que se torna uma intermediadora de escritórios, colocando-se entre departamentos jurídicos e escritórios e, assim, capturando esse fluxo financeiro.

Diante do crescimento de faturamento, a empresa atraiu investidores globais, ampliando sua força comercial e catapultando seu movimento de emplacar o modelo em algumas empresas.

No entanto, o presidente nacional da OAB, Beto Simonetti, declarou que “a inovação é bem-vinda. O exercício ilegal da profissão jamais será tolerado”. Além disso, expressou que “empresas vêm comercializando soluções de inteligência artificial que, sob o argumento de inovação tecnológica, acabam por exercer ilegalmente atividades privativas da advocacia, captar clientela e colocar em risco milhares de postos de trabalho de advogadas e advogados em todo o país”.

Reportagem recente expressa que "com a autorização do plenário, a diretoria da OAB analisará os casos e, sempre que identificar violação à diretriz aprovada pelo Conselho Federal, poderá ingressar na Justiça com as medidas cabíveis".

Veremos uma ação judicial da OAB ser distribuída contra a Enter? E, sendo distribuída, qual será o resultado?

Se o Judiciário entender que é ilegal, o modelo deverá ser encerrado. Nesse contexto, a Enter vai ter que se reinventar para continuar gerando receita.

Se o Judiciário entender que é legal, o efeito será o oposto. O mercado financeiro, leia-se fundos de private equity, venture capital e outros investidores institucionais, encontrará um caminho para acessar um dos maiores mercados jurídicos do mundo.

Capital passará a entrar de forma mais agressiva, financiando empresas, consolidando operações e adquirindo negócios capazes de capturar parte relevante do fluxo financeiro hoje concentrado nos escritórios de advocacia.

Nesse cenário, não estaremos falando apenas de uma discussão sobre a Enter. Estaremos diante de uma potencial mudança estrutural na indústria jurídica brasileira.

A discussão é válida. É fato que a IA já revoluciona, e continuará revolucionando, o mercado jurídico.

A grande dúvida sobre o futuro talvez seja outra
